Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The 10th amendment states that any power not officially given to the federal government is awarded to the state.

Each individual state has the right to make its own rules as long as they don't conflict with the federal government's rules.
